The bench of CJI SA Bobde, Justice AS Bopanna and Justice V Ramasubarmanian in the case of Mohammad Salimullah v. Union of India ordered that no refugee would be deported without following proper procedure. The plea was filed to free 150 refugees held in Jammu and Kashmir. The petitioner pleaded for a refugee identification card from Foreigners Regional Registration Office.
The Union argued that they are not refugees but illegal migrants and will be deported according to law. The Solicitor General Tushar Mehta said, "They are illegal immigrants. We are always in touch with Myanmar and if they confirm, then they can be deported,".
The Jammu-based NGO, Forum for Human Rights and Social Justice, contended before the Court that plea to stop deportation should not be entertained as it will destabilise the tense and internationally sensitive area.
