    Manipur High Court Declared Election Of Congress MLA As Null And Void Due To Misrepresentation

    The single-judge bench of Justice MV Murlidharan declared the election of congress member Okram Henry Singh as null and void due to the misrepresentation in the election affidavit filed in the 11th State Assembly election.


    The election petition was filed by Yumkham Erabot Singh, a BJP candidate, contending that the elected MLA misrepresented his education qualification details, criminal cases and did not declare the name of his spouse and his dependents. Henry Singh in the 10th State Assembly Election declared himself as a BA graduate while in the 11th State Assembly Election declared himself as 12th passed. He also did not disclose information about the pending criminal cases under the Negotiable Instrument Act, NDPS Act.


    The Court under Section 123 (2) of Representative of People Act 1951 declared the election of Henry Singh from the 15-Wangkhei Assembly constituency and declared the petitioner as a duly elected member.
