A three judge bench observed that there was no reason to interfere with the orders of high court which had decided to set aside the Dr. Kafeel Khan's detention under NSA. The bench comprised of Chief justice of India SA Bobde, Justice AS Bopanna and Justice V Ramasubramanian. The honorable Supreme Court said, "We see no reason to interfere" while quashing the appeal filed by government. A division bench of Chief justice Govind Mathur and Justice Saumitra Dayal Singh of Allahabad high court has allowed the writ petition filed by the mother of Dr. Khan and quashed his detentions order. The Uttar Pradesh government filed a plea against the orders of the court which was dismissed by the Honorable Supreme Court. It also said that the other case of crime which are filed against the Khan will be decided on its own merits. Dr. Khan was lodged in Mathura jail and detained under NSA for allegedly booked for provocative speech at Aligarh Muslim University at the backdrop of protests against the Citizenship Amendment act. But High court in its judgement noted that the speech was not spreading violence or hatred instead it was actually calling for national integrity and unity.
