The Madras high court observed that there was a delay in the establishments of a bench in NCLAT in Chennai. It will amount to contempt of Supreme Court’s direction.

This decision to establish NCLAT in every state was taken in Swiss Ribbons case. This was done because NCLAT was first situated in New Delhi only. Due to which a lot of hardships were faced by the litigants of southern part who had to travel which was both financially expensive and time consuming.

At this juncture the bank had directed the ASG to file counter affidavit and posted the matter for hearing on January 28, 2021.
