On Friday, Whatsapp has informed Delhi High Court that no new privacy policy will be brought into force until the Personal Data Protection Bill, 2019 comes into force.
The Delhi High Court has postponed its hearing on the plea filed by Whatsapp and its Parent Company Facebook against the order passed by the Single Judge not to interfere with the Competition Commission of India’s probe for a new privacy policy.
“ The difficulty appears to not only you are collecting all this data but you are also giving it to somebody else without the permission of the person.” Remarked by the Division Bench of Chief Justice D. N. Patel and Justice Jyoti Singh.
Harish Salve, Senior Counsel appearing for Whatsapp contended to the Court that Whatsapp has no intention of enforcing a new privacy policy till the Private Data Protection Bill comes into existence.
Questions were raised by the counsels on the ground that if Parliament makes law and allows it to share data, the CCI cannot then form a ground on questioning why Whatsapp is sharing data.
Senior counsel Mukul Rohatgi, Facebook's counsel also objected to the suo moto jurisdiction initiated by the CCI.
As the response filed by CCI was not on record, the matter will be reheard on July 30, 2021.
