The Supreme Court recently confirmed the Telangana High Court's conclusion that shielded renters are assumed to be owners after receiving an ownership certificate under Section 38E of the Tenancy Act. The purchasers were stripped of their ownership by virtue of the issue of ownership certificate under Section 38E of the Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950, hence there could be no occupancy rights certificate after the protected tenants were regarded to be owners.
